Terms of Service for Pets to Art

Welcome to Pets to Art, a service operated by Modular Technology Group, based in Shelbyville, Kentucky ("Company," "we," "us," or "our"). Please read these Terms of Service ("Terms") carefully as they govern your access to and use of the Pets to Art website and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this requirement.

2. User Accounts

You may be required to create an account to access some features of the Service. You agree to provide accurate, complete, and current information during registration and to keep your account information up-to-date. You are responsible for safeguarding your password and any activities under your account.

3. Purchases and Payments

If you purchase products or services through the Service, you agree to provide current, complete, and accurate payment information. We use third-party providers for payment processing. All transactions are subject to our Refund Policy. Subscription fees and purchases are non-refundable except as required by law.

4. User Content

You retain ownership of any content you upload, such as pet photographs ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the User Content for the purpose of providing our services.

5. AI-Generated Content and Ownership

By submitting content (including but not limited to photos of pets) to the Service, you agree and acknowledge that any resulting output generated by the platform's AI models—including modified, enhanced, or transformed images ("Generated Content")—is considered derivative work created by Modular Technology Group, the owner and operator of Pets to Art.

You grant Modular Technology Group a perpetual, irrevocable, worldwide, exclusive, royalty-free license to use, reproduce, modify, publish, distribute, sublicense, and sell the Generated Content for any commercial or non-commercial purpose. You acknowledge that this license remains in effect even if you delete your account or discontinue use of the Service.

Modular Technology Group retains full ownership and intellectual property rights to all Generated Content, and you waive any claim to such content, including but not limited to requests for removal, royalty participation, or attribution.

6. Prohibited Activities

You agree not to:

• Use the Service for unlawful purposes
• Upload content that infringes on third-party rights
• Impersonate another person
• Attempt to access non-public areas of the Service
• Distribute viruses or malicious code

We reserve the right to suspend or terminate your account if you engage in prohibited activities.

7. Intellectual Property

All content provided on the Service, except for User Content, is the property of Modular Technology Group or its licensors. You may not copy, reproduce, or use any content without prior written permission.

8. Termination

We may suspend or terminate your access to the Service at our sole discretion, without notice or liability, for conduct that we believe violates these Terms.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, Modular Technology Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in Shelby County, Kentucky.

12. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
